Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the Retivo platform, APIs, SDKs, and related services (the “Service”) operated by Theoremus Ltd (“Retivo”, “we”, “us”). By using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

Retivo is an autonomous AI customer success platform. The Service observes end-user behavior, makes decisions about when and how to intervene, and executes actions (messages, in-app nudges, webhook calls) on your behalf. You are responsible for configuring playbooks, approval modes, and communication preferences.

3. Your account

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at security@retivo.ai if you suspect unauthorized access.

4. Your data

You retain all rights to data you submit to the Service (“Your Data”). You grant us a limited license to process Your Data solely to operate the Service. We will not access Your Data except as necessary to provide, maintain, or troubleshoot the Service, or as you direct.

You are responsible for ensuring you have the legal basis to share end-user data with us and that your use of the Service complies with applicable data protection laws.

5. AI-generated content

The Service generates messages, recommendations, and decisions using AI models. While we implement safety measures (brand voice enforcement, content filtering, frequency caps), AI-generated outputs may occasionally be inaccurate or inappropriate. You can use approval modes (semi-auto, manual) to review outputs before delivery.

You are responsible for the messages sent to your end-users through the Service, including AI-generated content. We recommend starting in semi-auto or shadow mode to validate outputs before enabling full automation.

6. Acceptable use

You agree not to:

  • Use the Service to send spam, phishing, or deceptive communications
  • Violate any applicable law, regulation, or third-party rights
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Exceed rate limits or circumvent usage restrictions
  • Use the Service to build a competing product
  • Share account credentials or allow unauthorized access

We reserve the right to suspend accounts that violate these terms.

7. Pricing & billing

Paid plans are billed monthly or annually as selected. Prices are subject to change with 30 days notice. If you exceed your plan’s tracked user or decision limits, we will notify you and may upgrade your plan or throttle the Service. Refunds are handled on a case-by-case basis.

The free trial provides full Starter plan access for 14 days with no credit card required. At the end of the trial, you must select a paid plan to continue using the Service.

8. Service availability

We target 99.9% uptime but do not guarantee uninterrupted availability. We will provide reasonable notice of scheduled maintenance. We are not liable for downtime caused by factors outside our reasonable control.

9. Limitation of liability

To the maximum extent permitted by law, Retivo’s total liability for any claims arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue or data.

10. Termination

Either party may terminate at any time. You can cancel your account from the dashboard or by contacting support. Upon termination, we will delete Your Data within 30 days unless you request an export. Sections that by their nature should survive termination (liability, disputes, data deletion) will survive.

11. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email or dashboard notice. Continued use of the Service after changes take effect constitutes acceptance.
